General

The following terms and conditions (henceforth: the Terms and Conditions") are valid between you and CL Ståle (Reg. No. 1996 07 21 6133) (henceforth: CL Ståle; may be referred to as "us" and "we") and apply to all use of and orders placed on CL Ståle website www.clstale.com, and orders made by telephone, e-mail or by live chat with CL Ståle's Customer Service team (henceforth together: the "Website"). Please note that CL Ståle does not guarantee that all products presented on the Website are in stock or are available for purchase. CL Ståle reserves its right to stop selling a product. Orders can only be placed by persons that are 18 years or older and are located in Sweden at the time of the placement of the order. Orders placed with Klarna Invoice can only be placed by Swedish residents. CL Ståle reserves the right to revise the Terms and Conditions at any time. The date of the latest update is found in the final section of the Terms and Conditions. Users are responsible for keeping themselves updated with such changes. Please note that the terms and conditions valid for your order is always the terms and conditions that is in effect as of the time that you place your order and not a later version. You should keep a copy of these Terms and Conditions for future reference.

Language

The language of the Terms and Conditions is English.

Placing order

By using the Website and/or placing an order on the Website, by telephone, e-mail or by live chat you confirm that you have read the Terms and Conditions and the Privacy Policy, and that you accept them. Please make sure that you have read and understood the Terms and Conditions before you place an order. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of products may be lost. In such case, you will be required to re-enter your selection of products to the shopping bag.

Order confirmation

After submitting your order, we will send you an order confirmation e-mail with your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order.

Acceptance and shipping confirmation

Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order. The shipping confirmation or pick-up notification is our acceptance of your order. Please note that Acne Studios does not guarantee that all products presented on the Website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by e-mail. If we already have received payment for such product we will refund you the amount of the purchase.

Colors

CL Ståle's goal is to describe the products at the Website as correctly as possible. However, please note that due to the color settings of your computer, the colors of the products shown in the pictures on the Website can differ somewhat from their actual colors. CL Ståle cannot be held responsible for any such discrepancy.

Prices

The prices and delivery costs shown on the Website include VAT. The prices and delivery costs shown on the Website may vary from time to time and CL Ståle is not bound by the price until CL Ståle's has accepted the order by sending the shipping confirmation to you. The prices may also vary between the physical store and the Website. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. CL Ståle always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a cancelled order we will refund you the amount of the purchase. Please also note the CL Ståle may cancel the order even if it has been accepted by CL Ståle under the condition that you realize or should have realized that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.

Payments

The following payments are accepted.

Credit cards

Payment can be made by the following credit cards: Visa, Mastercard and American Express. The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once CL Ståle has sent you the order confirmation email.

We do our best to make the Website as secure as possible. All credit/debit card transactions on the Website are processed using Adyen, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account upon acceptance of your order by Acne Studios. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to CL Ståle, your order will be cancelled.

We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

Paypal

When selecting the PayPal option, you will be directed to the PayPal site to "Log In" and review the amount shown before clicking "Pay Now". Once this transaction is complete, you will then return to the Website.

Invoice

Invoice payment is done in cooperation with Klarna and Klarnas payment terms apply. To read Klarnas payment terms please see

. Please note that when invoice payment is chosen your shipping address needs to be your registered residence.

Stored Credit Cards

At Checkout you can chose to save your credit card for future purchases if you are logged in to your CL Ståle account. Your details will be protected using Global Sign Encryption and will speed up your checkout the next time you shop.

Delivery

Shipping methods

We offer different shipping methods to meet your needs as further specified when you check out. Dispatch of orders may take up to 7 business days but we aim to dispatch all orders within 24 hours during weekdays, or 1-2 business days during sales periods. Please note that delivery times are provided as guidelines only, and commence from the date of dispatch. The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If CL Ståle fails to deliver within 30 days, you may have the right to cancel the purchase.

Your order will be delivered to your local delivery point or if you have chosen PostNord HemPaket or Budbee to your home. A delivery notification will be sent via SMS when your package is ready to be collected or delivered to your home. All orders are fully traceable on the Website by logging in to My account. Click "My Orders" and fill in the tracking number for updated information about your shipment. For orders you have chosen to collect in-store, tracking information will not be displayed – please wait for an email notification stating that your item is ready to be picked up.

First-time order policy

For security purposes, CL Ståle reserves the right to ship first-time orders to the cardholder's verified billing address or work address. To avoid delays in receiving your order, please make sure to provide the correct billing and shipping information associated with your credit/debit card when placing an order.

Right of withdrawal and returns

Withdrawal

You are entitled to withdraw your purchase or exchange your product by submitting or sending notice thereof to CL Ståle within 14 days of the date on which you have received the product. The notice may be sent in different ways. Preferably, you can use our Return Merchandise Authorization (RMA) system. You can also use the standard form that can be found at Konsumentverket.

Please note that you of course do not need to use the special forms but may send us a letter or an e-mail to the above-referenced mailing and e-mail addresses including information that you will withdraw or exchange your purchase. If you send us an e-mail we will send you a confirmation upon receiving your notice. Please always refer to your order number in you communication with us. You may wish to keep a copy of your cancellation notification for your own records.

Refund relating to the right of withdrawal

If you choose to withdraw your purchase in accordance with the terms set forth in this section 11, CL Ståle will issue a refund of the amount paid to CL Ståle including the shipping cost you have paid for the delivery from CL Ståle to you. However, if Express shipping or PostNord Home Delivery has been used, CL Ståle will not issue a refund of the original shipping fee. CL Ståle will pay the refund within 14 days of the date on which we have received your notice of withdrawal, under the condition that CL Ståle has received the product/s from you or if CL Ståle has obtained proof that the products have been sent back to CL Ståle. The refund is made using the same payment method you used at the purchase if you do not explicitly accept another method. You will not be charged extra if another payment method is used. Please note that CL Ståle only issues a full refund if the product/s is in the same conditions as at the time of delivery. If the products’ value has diminished due to your handling of the products to a greater extent than is necessary in order to ascertain its characteristics or function, you have an obligation to reimburse us. Thus, CL Ståle then has the right to withhold such amount of the refund. To avoid a deduction, please make sure the product you wish to refund is in the exact same condition as when you received them, with tag and seal still attached. All shoes must not be used at all or on a carpeted surface until you have decided to keep them. Shoes and accessories that come in a special box must be returned in their undamaged original box which is considered to be a part of the product.

Exchanges

Purchased products are exchangeable into a different size and color in accordance with the terms set forth in this section 11. All exchanges are based on stock availability. If you have exchanged a product, CL Ståle will pay the shipping costs for the new product. Please note that sale products are non-exchangeable but can be returned with a full refund. Please note that if you wish to exchange a product for a new product and/or size and the order has been placed with Klarna simply return your product and place a new order with your preferred payment method. If the complete order is returned, your Klarna invoice will be cancelled. However, if you have made a partial return, a new updated invoice will be sent to you by e-mail. The new order is paid for separately and will be handled as a new order.

Shipping costs for returning the products

CL Ståle offer a free return service and Acne Studios will pay the shipping cost for returning the products sent from Sweden in accordance with your right of withdrawal and exchange.

Returning the products

Upon your withdrawal or exchange of your purchase, please return the product/s as soon as reasonably practicable but no later than 14 days after sending your notice. You can return the product to us online or to one of our physical stores, see below.

When returning your order online, please follow the steps below.

Visit www.clstale.com and log into your account to begin a return or exchange.

You can view your orders and must request a return or exchange item for any unwanted items.

If you checked out as a guest, visit our Returns page, and enter your order information to request a return or exchange.

Place the item(s) in the original shipping box, or any other solid carton box.

Close the box and tape it securely.

Place the pre-paid return shipping label on the box over the prior delivery information.

Leave your parcel at your nearest PostNord service point, preferably the same one as where you collected your order.

Returning ‘collect in-store’ orders

Should you have chosen to collect an order placed on acnestudios.com in a store, the item will be held in-store for a period of 14 days from, and including, the date on which you receive a notification email that the order is ready to be picked up. If the order is not picked up within that period,CL Ståle will refund the full order balance to the payment source used for the original purchase.

Once your order is collected in-store, the terms listed above for returns and exchanges of orders placed on www.clstale.com apply. As you will not receive a pre-paid return label when you collect in store, please contact

with your order information and request that a label be sent to you.

We prefer that products are returned through CL Ståle return service to ensure they are protected and insured during transit. However, you may return the products by any secure transport.

Returning your purchase to one of our physical stores

Within 14 days of receipt, our stores in Sweden can accept returns of online purchases made in Sweden for a refund to the original form of payment. You must bring your online order number in order to receive assistance, and our regular online return policy applies to any returns/exchanges made in-store.

Defective products

If you receive defective products, please notify us immediately. According to the Consumer Act (1990: 932) you are entitled to complain about defective products within three years. However, you must always notify CL Ståle within a reasonable time after you have detected that the products are defective. If CL Ståle consider the products to be defective, CL Ståle will make a full refund including shipping costs. Please see more information about your legal consumer rights in the Consumer Act (1990: 932).

Acne Studios' quality guarantee

CL Ståle acts in accordance with applicable consumer regulations. Please notify us as soon as possible after receiving defective products.

Who is responsible for the processing of your personal data?

Categories of data processed, purpose and legal basis for processing

General

Below is a summary of the categories of data that we process, the purposes of processing the data and on what legal basis we are processing your data. Our processing of your personal data partly depends on whether you have subscribed for membership with us or not. The processing of personal data relating to customers that are not members is described in section 3.2 below. The processing of our members’ personal data is described in section 3.3 below.

Customers (non-members)

Data collected when you shop in our webstore or use our online services

Contact details: If you make a purchase online we will collect your name, address, e-mail address, telephone number, country of residence, date of birth, title (Ms./Mr. or other title) and social media account contact details. Not all information is mandatory for making a purchase. We have marked mandatory information with the symbol (*) on our website. This will allow you to keep track of your purchases and returns, and recently viewed items, by logging into your personal account. We will also save information on your contact details and previous purchases and returns during 36 months after the purchase to be able to administer returns and/or complaints. ID number: If you chose to make your payment by invoice, you may be required to provide your personal ID number on our website. Your ID number will be directly transferred and available only to our payment service provider, which will process your ID number to be able to obtain a credit report and to facilitate your payment. The legal basis is that the processing is necessary for us to ensure accurate identification of our customers for invoice purposes and to fulfill our contractual obligations to you under the purchase agreement. We will retain your data for as long as necessary for this purpose.

Data collected when you shop in our physical stores

If you make a purchase in one of our physical stores we may process your e-mail address in order to be able to send a digital receipt to you. We will only collect your email address and send you a digital receipt if this has been requested or accepted by you. This processing is based on our legitimate interest of being able to provide our customers with a digital receipt on a voluntary basis. Members

You may sign up for membership by subscribing to the services provided by CL Ståle in accordance with the Membership Policy. The membership is completely voluntary and subscribing for membership is not a requirement for purchasing Acne Studios’ goods. When you subscribe to become a member, you will enter into an agreement with CL Ståle (the Membership Policy).

Data collected when signing up for membership

When you sign up for membership (online or in CL Ståle physical stores), CL Ståle collects your name, address, e-mail address, telephone number, country of residence, date of birth, title (Ms./Mr. or other title) and social media account contact details. CL Ståle processes the data to create your personal account and to process the membership which includes certain features such as (i) sending digital receipts upon request when purchasing a product in a physical store, (ii) sending out invitations to special events/promotions, (iii) personalized services in store, and (iv) profiled marketing offers through e-mail or other messenger services. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy. We will retain your data for as long as necessary for this purpose.

Data collected when shopping online

Contact details: When you purchase a product online, CL Ståle will process your contact details for the following purposes; (i) to process purchases/orders and returns, exchanges and complaints; (ii) to communicate with you regarding the purchases and to answer and administer any questions or comments that you may have regarding CL Ståle products or services. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the purchase agreement.

Previous purchases and returns: CL Ståle will also process data regarding your contact details and previous purchases and returns online (product, size, price and date of purchase) during 36 months after the purchase. The information will be processed for the following purposes:

Administering returns and complaints. The processing is based on our legitimate interest to provide our members with speedy and efficient service after the purchase.

Allowing you to keep track of your purchases and returns by logging into your account. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy.

For the purpose of sending out invitations to special events/promotions, personalized services in store and profiled marketing offers through e-mail or other messenger services. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy.

Credit card details: If you make a purchase online and chose to pay by credit card, you will provide your credit card information on the website for the purpose of making payment for the purchase. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the purchase agreement. As a member you may also choose to save your credit card details for future purchases, for the purpose of speeding up the checkout the next time you shop. The legal basis for this processing is your consent. We will retain your data for as long as necessary for this purpose.

ID number: If you chose to make your payment by invoice, you may be required to provide your personal ID number on our website. Your ID number will be directly transferred and available only to our payment service provider, which will process your ID number to be able to obtain a credit report and to facilitate your payment. CL Ståles may also store data regarding your purchases and returns in physical stores (product, size, price and date of purchase) if you have provided your e-mail address to CL Ståles personnel. This information is processed for the purpose of enhancing your future purchasing experience with Acne Studios and to provide customized service, which is part of CL Ståles membership service. CL Ståles may also use the information regarding your shopping preferences for the purpose of sending out invitations to special events/promotions and profiled marketing offers through e-mail or other messenger services. The legal basis for this is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy. We will retain your data for as long as necessary for this purpose.

Data collected when using Acne Studios website services

CL Ståles will store information regarding your recently viewed items when browsing CL Ståle website. This will allow you to keep track of your recently viewed items, by logging into your personal account. The legal basis for this is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy. We will retain your data for as long as necessary for this purpose.

Newsletter Subscribers

If you have subscribed to one of our newsletters, we will process your name, email address, country and information on whether you are interested in womenswear or menswear for the purpose of sending out such newsletter. The legal basis for this processing is our legitimate interest of being able to send our newsletter to individuals who have subscribed to receiving such newsletters. You are entitled to unsubscribe to our newsletter at any time by clicking on the unsubscribe link included in each newsletter or by contacting customer service at

Customer service

If you have contacted Acne Studios regarding a complaint, return or question, the e-mail or chat conversation will be stored for as long as it is necessary to administer your matter, including following up on the matter within 12 months. Depending on the nature of the matter for which you are contacting us, the legal basis may be that our processing is necessary for us to be able to fulfill our obligations under the purchase agreement or Membership Policy, or that we have a legitimate interest of being able to communicate with individuals who contact our customer service.

Anonymized data

It can be noted that we may also use anonymized data for our internal marketing and demographic studies to analyze, profile and monitor customer patterns in order for us to be able to improve our products and services.

Consent and withdrawal

You hereby confirm that you have read and understood the content of this privacy policy. Where the legal basis for the processing of your personal data is your consent you agree to Acne Studios’ processing of your personal data in accordance with the provisions herein. Should you wish to object to, or withdraw your consent, to any of our processing, please contact us.

Does CL Ståle share your information with others?

CL Ståle does not sell or rent our customer’s personal data to any other entity.

We may share your data with affiliated companies including other companies within the CL Ståle group, joint ventures, franchisees and licensees. If you have subscribed for membership with CL Ståle, we may combine your data provided to us with data that you have provided to such affiliated companies, for the purpose of improving our services to you, and to enhance your shopping experience when visiting an CL Ståle store in another country than your residence. The legal basis for the processing is that it is necessary for CL Ståle’ performance of the Membership Policy.

CL Ståle may also share your data with selected suppliers who perform functions on our behalf such as fulfilling orders and delivery of orders, processing payments, carrying out promotional services or data management, to maintain our website, to distribute e-mails, to send out our newsletter, to provide client communications and to manage our customer database. As necessary, the personal data you provide to us may be processed by these third parties, solely on CL Ståle behalf and in accordance with CL Ståle instructions as data processors. We do not authorize any of our suppliers to make any other use of your personal data.

If CL Ståle and/or its subsidiaries are subject to an actual or potential merger or acquisition or similar transaction, we may share your data with potential and actual buyer(s) and their financial and legal advisers, subject to such third parties undertaking appropriate confidentiality.

Transfer outside of the EU/EEA

We may share your data with our selected suppliers, who may process your data in countries both inside and outside of the EU/EEA when performing functions on our behalf as set out in section 4 above.

If you have subscribed to membership with Acne Studios, we will share your contact details and information on previous purchases and shopping preferences with our affiliated companies both inside and outside of the EU/EEA (please see further under section 4).

Please note that countries outside of the EU/EEA may not provide an adequate level of protection for your personal data.CL Ståle has however taken appropriate safeguards to ensure that the receiving parties of your data in countries outside of the EU/EEA shall provide an adequate protection of your data. Such safeguards may be that the receiving party has joined the Privacy Shield (if the receiving party is a company established in the United States) or that the receiving party has signed so called standard data protection clauses adopted by the EU Commission. Your data subject rights

In this section 6, we have summarized your data subject rights to request access, portability, rectification, erasure of your personal data, to restrict the processing of your personal data, to object to processing, and your right to lodge a complaint with the supervisory authority.

If you have signed up for a membership with CL Ståle you will also be able to access, rectify and erase some of your data by logging in to your private account.

Notwithstanding anything to the contrary herein, CL Ståle reserves the right to keep and process your personal data in accordance with this policy to the extent necessary to perform our contractual obligations to you, and to the extent we are required to process your data by law or in order to defend ourselves in a dispute, to prevent fraud or abuse, or to enforce our Terms and Conditions.

Right of access

You have the right to obtain confirmation of whether personal data concerning yourself are being processed and, where that is the case, access to the personal data and information regarding, inter alia, the purpose of processing, the categories of personal data concerned, the categories of recipients to whom your data have been or will be disclosed, and the envisaged period of time for which personal data will be stored (or the criteria for determining this).

Right of rectification

You have the right to request rectification of inaccurate personal data concerning yourself, and to complete incomplete data.

Right of erasure

Under certain circumstances you are entitled to request that we erase your personal data or restrict our processing of your data, namely in the following events.

When it is no longer necessary for us to process your data taking into consideration the purposes for which it was collected.

When our processing is based on your consent and you have withdrawn your consent, and there is no other legal basis for the processing of your data.

When our processing of your data is based on a legitimate interest legal basis and you object to such processing, and there is no overriding legitimate ground for our processing.

When you have objected to our processing of your data for direct marketing purposes.

When your personal data has been unlawfully processed.

How long do we keep your data?
